Delhi MenCell: झूठे Criminal Case के बाद Husband क्या Mental Cruelty का Divorce Claim कर सकता है?
“मैं criminal case में acquit हो गया… लेकिन मेरी शादी और मेरी जिंदगी का क्या?”
यह सवाल किसी भी Delhi husband, Delhi-NCR husband या matrimonial case में फँसे आदमी के लिए बहुत real हो सकता है।
लेकिन law में एक important difference है।
31 August 2026 को Chhattisgarh High Court ने Vivek Agrawal v. Sarita Agrawal, FA(MAT) No.156/2025 में एक husband को divorce grant किया, जहाँ matrimonial disputes के साथ wife द्वारा लगाए गए criminal allegations भी litigation का हिस्सा बने थे।
Court ने पाया कि husband को Section 498-A/34 IPC के criminal case में prosecute किया गया था और वह 17 March 2026 को acquitted हुआ। High Court ने कहा कि केवल complaint file होना या केवल acquittal होना अपने-आप mental cruelty साबित नहीं करता। लेकिन जब evidence से allegations false पाए जाएँ और prosecution का पूरा effect matrimonial relationship पर देखा जाए, तो circumstances अलग हो सकते हैं।
इस case में Court ने सिर्फ FIR को नहीं देखा।
Separate residence की लगातार मांग, aged parents को लेकर dispute, prolonged separation, matrimonial conduct और criminal prosecution — पूरा conduct collectively examine किया गया।

Evidence preserve करना पड़ता है।
Dates, notices, complaints, acquittal judgment, WhatsApp communications, settlement attempts और Court proceedings — सबकी chronology बाद में बहुत महत्वपूर्ण हो सकती है।
और एक और important point: Court ने यह भी स्पष्ट किया कि wife का separate residence चाहना अपने-आप cruelty नहीं है। Facts, justification और manner matter करते हैं।
इसलिए अगर आपका Delhi matrimonial case, 498A case, domestic violence dispute या family litigation चल रहा है, तो शुरुआत से अपनी side का documentary record बनाना बहुत जरूरी है।
एक complaint आज सिर्फ एक complaint लग सकती है। लेकिन कई साल की litigation में वही documents आपकी defence story की backbone बन सकते हैं।

यह post इसी particular judgment के facts पर आधारित है। Court ने उस case में allegations, evidence, acquittal और overall matrimonial conduct को collectively examine किया। इसका मतलब यह नहीं है कि हर 498A complaint, हर acquittal या हर matrimonial dispute में husband को automatically divorce या mental-cruelty finding मिल जाएगी।
